Actions Needed

Issued: December 3, 2024

Amendments to the PayPal User Agreement
Effective January 13, 2025:

  • The fees PayPal business accounts pay for receiving transactions are being updated for certain Payment Types, as follows:
    • PayPal Pay Later options. PayPal business accounts, when acting as sellers, will be charged a standard domestic rate of 4.99% plus a fixed fee per transaction when a buyer uses a PayPal Pay Later option to fund their purchase, including when the purchase occurs through PayPal’s Invoicing service.
      • If desired, PayPal business accounts can opt out of PayPal Pay Later option availability by logging in to their account with PayPal and going to the Pay Later section of their Account Settings. If a PayPal business account holder chooses to opt out in this manner, PayPal Pay Later options will not be available to that account holder’s buyers at PayPal Checkout.
      • For more information about PayPal Pay Later options generally, visit:  https://www.paypal.com/us/business/accept-payments/checkout/installments
    • Alternative Payment Method(s). The standard domestic rate for Alternative Payment Method (APM) transactions will be 2.89% plus an updated fixed fee per transaction. At this time, there is no change to fees for APM transactions when the purchase occurs through PayPal’s Invoicing service or to fees for APM transactions through Pay Links and Buttons.

    • Advanced Credit and Debit Card Payments. The standard domestic rate for Advanced Credit and Debit Card Payment transactions will be 2.89% plus an updated fixed fee per transaction. The domestic charity rate for Advanced Credit and Debit Card Payment transactions will be 2.19% plus an updated fixed fee per transaction. At this time, there is no change to fees for Advanced Credit and Debit Card Payment transactions on the Interchange Plus Plus fee structure.

    • Virtual Terminal. The standard domestic rate for Virtual Terminal transactions will be 3.39% plus an updated fixed fee per transaction. The domestic charity rate for Virtual Terminal transactions will be 2.69% plus an updated fixed fee per transaction.

  • The updated pricing listed above will result in fee increases for some transactions. You can preview the Merchant Fees Page below that will be effective following such changes. The preview also includes the updated fixed fees for the above listed Payment Types in all available currencies. At this time, there is no change to the additional percentage-based fee for international transactions.

Amendments to the Commercial Entity Agreement
Effective January 13, 2025:

  • The Commercial Entity Agreement is being amended to reflect the member banks that may process card payment transactions, consistent with the requirements of the card network rules.

Amendments to the PayPal Privacy Statement
Effective November 27, 2024:

  • We are updating our Privacy Statement to explain how, starting early Summer 2025, we will share information to help improve your shopping experience and make it more personalized for you. The key update to the Privacy Statement explains how we will share information with merchants to personalize your shopping experience and recommend our services to you. Personal information we disclose includes, for example, products, preferences, sizes, and styles we think you’ll like. Information gathered about you after the effective date of our updated Privacy Statement, November 27, 2024, will be shared with participating stores where you shop, unless you live in California, North Dakota, or Vermont. For PayPal customers in California, North Dakota, or Vermont, we’ll only share your information with those merchants if you tell us to do so. No matter where you live, you’ll always be able to exercise your right to opt out of this data sharing by updating your preference settings in your account under “Data and Privacy.”
  • We are also making other updates to our Privacy Statement including some additional disclosures related to your right, depending on the jurisdiction in which you reside, to ask us for a list of the third parties to which we have disclosed personal information, and to provide other clarifying information.

Amendments to PayPal's Seller Protection Program
Effective November 18, 2024:

  • We are revising the ‘Basic Requirements’ for PayPal’s Seller Protection program to include integration requirements for sellers who have integrated a PayPal Checkout product with their website.
  • We are revising PayPal’s Seller Protection Program to extend eligibility to Guest Checkout transactions received by accounts registered in certain countries.

Amendments to the PayPal Online Payment Services Agreement
Effective November 18, 2024:

  • We are changing this agreement to introduce a new service which will enable merchants to accept Automated Clearing House (“ACH”) payments, allowing their customers to use their bank accounts as a payment method.
  • Consequently, we are also renaming the PayPal Online Card Payment Services Agreement, and all references thereto, to the PayPal Online Payment Services Agreement.
  • We are also changing our Merchant fee page to introduce new fees relating to this service.

Discontinuation of the PayPal Fundraisers Program
Effective: October 7, 2024:

On October 7, 2024, PayPal will disable the ability to create Fundraisers.

  • All current Fundraisers will remain open until they expire.
  • You will need to move any funds from your existing Fundraisers into your PayPal balance no later than January 12, 2025. If you do not do so, we will move any remaining funds into your PayPal balance on January 13, 2025.
  • If you have created a Fundraiser for Charity, please keep a copy of the list of contributors to your Fundraiser for Charity for your records, as this information will no longer be available after January 12, 2025. You will be able to continue to track contributor information for other Fundraisers in your account activity.

Effective May 20, 2024:

  • We are updating the PayPal Advertising Program, including the corresponding terms and conditions within the PayPal User Agreement, to account for expansion and applicability of the PayPal Advertising Program in multiple sales channels, including in-store promotional messaging for qualifying PayPal business account holders. Additional updates are also being made to clarify the terms, including PayPal business account holder obligations.
  • We are clarifying our Taxes and Information Reporting terms and our currency conversion terms.

Amendments to the Pay Later Messaging Center Program Terms
Effective May 20, 2024:

  • We are updating the PayPal Advertising Program, including the corresponding terms and conditions within the Pay Later Messaging Center Program Terms, to account for expansion and applicability of the PayPal Advertising Program in multiple sales channels, including in-store promotional messaging for qualifying PayPal business account holders. Additional updates are also being made to clarify the terms, including PayPal business account holder obligations.

Amendments to PayPal’s Purchase Protection Program
Effective May 20, 2024:

  • We are revising PayPal’s Purchase Protection Program to exclude from eligibility:
    • Non-Fungible Tokens (NFTs);
    • Payments that you initiate via a third-party platform using your PayPal Balance account and assigned account and routing number (PayPal's Direct Debit functionality).
  • In addition to meeting all other eligibility requirements for PayPal’s Purchase Protection Program, disputes asserting Significantly Not as Described claims must be opened by the buyer in the Resolution Center within 30 days of the delivery or fulfillment of an order or within 180 days of the date a payment was sent by the buyer to the seller, whichever is sooner. The timeframes for opening other disputes asserting other claim types (including Item Not Received, Unauthorized Transactions, or other errors) are not changing at this time.

Amendments to PayPal’s Seller Protection Program
Effective May 20, 2024:

  • We are revising PayPal’s Seller Protection Program to exclude from eligibility Non-Fungible Tokens (NFTs) with a transaction amount of:
    • $10,000.01 USD or above (or equivalent value in local currency as calculated at the time of the transaction);
    • $10,000.00 USD or below (or equivalent value in local currency as calculated at the time of the transaction), unless the buyer claims it was an Unauthorized Transaction and the transaction meets all other eligibility requirements.

  • We are updating the PayPal Confirmed Charities Terms and Conditions to allow Grant Makers to send email to charities and to send grants to charities that do not require acceptance.

Amendments to the PayPal Zettle Terms and Conditions
Effective May 20, 2024:

  • The PayPal Zettle Terms and Conditions are being updated to reflect PayPal’s position as our merchants’ agent for settlement of funds, and resulting obligations for merchants, including receipt requirements under applicable law and the card network rules.
  • The PayPal Zettle Terms and Conditions are being amended to update the data processing clauses governing the use of the PayPal Zettle Services.

Amendments to the PayPal Privacy Statement

Effective December 13, 2023

  • We are updating the PayPal Privacy Statement to describe the account and personal information that can be seen by PayPal account holders and non-account holders (collectively “Users”) when you use the business profile service. You will be able to review and manage what business profile information is seen by other Users in your business profile settings.

Amendments to the PayPal User Agreement
Effective January 16, 2024:

  • The PayPal User Agreement is being updated to provide additional detail on how users authorize PayPal to charge the payment method(s) linked to their PayPal account and how users can later revoke that authorization.
  • The PayPal Rewards Program Agreement is being incorporated into the PayPal User Agreement and applies to eligible PayPal users participating in the PayPal Rewards Program.
  • We are revising the User Agreement to indicate the payment a seller receives from a buyer may be invalidated and reversed if the seller fails to respond or provide accurate and complete information to PayPal related to the buyer’s claims or chargebacks for such transaction within the timeframe communicated to the seller by PayPal.

Amendments to the PayPal Privacy Statement
Effective January 16, 2024:

  • We are updating the PayPal Privacy Statement to describe how we collect and use data if you also use the Venmo or Honey services. PayPal will use Honey and Venmo information to help improve your use of PayPal, including to personalize your PayPal experience.

Amendments to the PayPal Balance Terms and Conditions
Effective January 16, 2024:

  • The PayPal Balance Terms and Conditions are being updated to provide additional detail on how users authorize PayPal to charge their PayPal Balance account and the payment method(s) linked to their PayPal personal account and how users can later revoke that authorization.

Amendments to the PayPal Rewards Program Agreement
Effective January 16, 2024:

  • PayPal Rewards will expire if a user has not earned at least 10 points in the last 365 days or completed 3 qualified transactions on their PayPal account.

Amendments to PayPal’s Seller Protection Program
Effective January 16, 2024:

  • We are revising PayPal’s Seller Protection Program to exclude from eligibility Item Not Received claims filed by buyers as chargeback claims with their card issuers for card-funded transactions.

Amendments to the PayPal Payouts Terms and Conditions
Effective January 16, 2024:

  • The PayPal Payouts Terms and Conditions are being updated to clarify existing product functionality, including:
    • Eligibility requirements for recipients of payouts to successfully receive payouts; and
    • The respective responsibility of PayPal and senders with regard to payouts made using the PayPal Payouts product.
  • In addition, the updates provide that:
    • PayPal may require evidence of express recipient consent to receive communications in connection with payouts;
    • Customers must confirm that provision of information to PayPal does not constitute a sale of data to PayPal under applicable law; and
    • Customers may not imply PayPal or Venmo sponsorship or endorsement without prior permission nor may customers seek to obtain PayPal or Venmo user credentials.

Amendments to the Zettle Terms and Conditions
Effective January 16, 2024:

  • The Zettle Terms and Conditions are being amended to clarify merchants’ rights when processing American Express transactions.

Amendments to the PayPal Business Debit Mastercard Cardholder Agreement and the PayPal Balance Long Form and Short Form Disclosures
Effective January 16, 2024:

Please review the updates below, which take effect on the date noted above. You can also review the updated Cardholder Agreement for additional detail.

  • Adjustments to the ATM Domestic Withdrawal Fee to $2.50, ATM International Withdrawal Fee to $2.50, and Foreign Transaction Fee to 2.5%.

If you prefer not to accept these changes, please contact us at the customer service number provided in your Cardholder Agreement to close your Card Account.

Amendments to the PayPal User Agreement
Effective October 23, 2023:

  • The fees sellers pay for PayPal QR code transactions are being updated. Sellers will pay a standard rate of 2.29% plus an updated fixed fee per transaction received through a PayPal QR code. You can preview the Merchant Fees Page below that will be effective following such changes, which includes the updated fixed fee in all available currencies. The new pricing will result in fee increases for some transactions.
  • The User Agreement is being amended to clarify the scope and applicability of the Commercial Entity Agreement to specified card payments received by sellers and to make relevant updates consistent with the requirements of the card network rules.

Amendments to the PayPal Online Card Payment Services Agreement
Effective October 23, 2023:

  • The Advanced Credit and Debit Card Payments suite of functionality may include the ability to integrate eligible third-party wallets as add-on features. We’re revising our terms to indicate that if you choose to integrate such add-on features, you agree to the applicable third-party terms via your acceptance of the PayPal Online Card Payment Services Agreement. Such acceptance includes your acknowledgement and agreement that such third-party features and terms are provided, updated, and noticed solely by the relevant third party and not by PayPal.

Amendments to the PayPal Zettle Hardware and Delivery Terms
Effective October 23, 2023:

  • We are clarifying existing card network fraud liability limitations in the Hardware and Delivery Terms when PayPal Zettle merchants use manual keypad entry for transactions using cards that only have a magnetic stripe.

Effective October 23, 2023:

Amendments to the PayPal User Agreement
Effective October 23, 2023:

  • The fees sellers pay for PayPal QR code transactions are being updated. Sellers will pay a standard rate of 2.29% plus an updated fixed fee per transaction received through a PayPal QR code. You can preview the Merchant Fees Page below that will be effective following such changes, which includes the updated fixed fee in all available currencies. The new pricing will result in fee increases for some transactions.
  • The User Agreement is being amended to clarify the scope and applicability of the Commercial Entity Agreement to specified card payments received by sellers and to make relevant updates consistent with the requirements of the card network rules.

Amendments to the Commercial Entity Agreement
Effective November 1, 2023:

  • The Commercial Entity Agreement is being amended to reflect the member banks that may process card payment transactions, to clarify the scope and applicability to specified card payments received by sellers, and to make relevant updates consistent with the requirements of the card network rules.

Amendments to the PayPal Online Card Payment Services Agreement
Effective October 23, 2023:

  • The Advanced Credit and Debit Card Payments suite of functionality may include the ability to integrate eligible third-party wallets as add-on features. We’re revising our terms to indicate that if you choose to integrate such add-on features, you agree to the applicable third-party terms via your acceptance of the PayPal Online Card Payment Services Agreement. Such acceptance includes your acknowledgement and agreement that such third-party features and terms are provided, updated, and noticed solely by the relevant third party and not by PayPal.

Effective September 19, 2022:

  • U.S. business accounts will not be able to receive personal transactions from PayPal accounts outside the U.S. starting October 31, 2022.

  • The Agreement to Arbitrate will provide revised information on the process if disputes arise between you and PayPal, including additional information about arbitration, small claims disputes, and the payment of associated fees.
  • If you integrate or reference PayPal services on your website, we are clarifying that PayPal may use automated technologies (e.g., website crawling) to assess your website to ensure compliance with the user agreement and to combat fraud.

Amendments to the PayPal User Agreement

Effective March 21, 2022, we are:

  • Revising PayPal’s Seller Protection program to expand the list of ineligible items to include certain Non-Fungible Tokens (NFTs) with a transaction amount of more than $10,000 USD.
  • Revising the actions we may take if your eligibility for PayPal’s Seller Protection program is suspended. In such a case, we may treat amounts you retained under PayPal’s Seller Protection program in the past 30 calendar days as amounts owed to PayPal and debit your PayPal account accordingly.
  • Updating the Dispute Fee and Restricted Activities terms to include actions we may take and the dispute fees we may assess if the seller engages in a Restricted Activity.
  • Revising our notice terms for business accounts so that notice of changes may include posting information about the changes on our Policy Updates page or providing information about the changes by other written means (which may include email).
  • Increasing some of the fees that apply to buying and selling cryptocurrencies. You can preview the Consumer Fees page that will be effective on March 21, 2022, following such changes.

Effective March 31, 2022, we are:

  • Aligning our American Express Payments pricing with the pricing for other card types on our Merchant Fees page. For the applicable Payment Types, this alignment will (1) reduce the percentage fee and introduce a fixed fee for the applicable transaction rates and (2) introduce an additional percentage-based fee for applicable international transactions. Amendments to the PayPal User Agreement

Effective December 10, 2021, we are:

  • Relocating PayPal’s Buyer Protection program and Seller Protection program terms to separate web pages. These program terms are accepted at the time you agree to the User Agreement and remain part of the User Agreement. The relocation is intended to make the terms easier to locate and navigate.
  • Revising PayPal’s Seller Protection program to clarify that proof of shipment and proof of delivery also must include an online verifiable tracking number.
  • Clarifying that abuse of our online dispute resolution process, PayPal's Purchase Protection program, and/or PayPal’s Seller Protection program are restricted activities as defined under the user agreement.

 

Amendments to the PayPal Data Protection Addendum for Card Processing Products

Effective December 10, 2021, we are:

  • Updating our PayPal Data Protection Addendum for Card Processing Products to incorporate the new Standard Contractual Clauses that were adopted by the European Commission in June 2021 as well as the UK standard contractual clauses.

Amendments to the PayPal Online Card Payment Services Agreement

Effective December 10, 2021, we are:

  • Updating the Chargeback Protection Services terms to clarify that you must have a PayPal business account in good standing to be eligible for such services and to provide that PayPal has the right to cancel or suspend such services immediately if reasonable notice is impracticable in order to maintain the security of PayPal’s systems and/or your account is no longer in good standing.

Amendments to the PayPal User Agreement

Effective: September 21, 2021

  • We are revising PayPal’s Seller Protection program to clarify eligibility for certain claims involving travel tickets sold by the travel carrier.
  • We are revising the length of time sellers have to notify us of any pricing errors or discrepancies to be sixty (60) days from having access to their account statement(s) or other account activity information.
  • We are clarifying the types of costs used to calculate the reasonable minimum estimate that we may recover if you engage in any restricted activities.

 

Amendments to the PayPal Acceptable Use Policy

Effective: September 21, 2021

  • We are revising the policy to clarify that violations may subject you to damages. We are also expanding the existing list of prohibited activities and clarifying the commercial activities requiring pre-approval.

 

Amendments to the PayPal Here Agreement

Effective: September 21, 2021

  • We are updating the PayPal Here Agreement so that it links to and incorporates the PayPal Data Protection Addendum for Card Processing Products for the applicable data protection terms. PayPal is now a “Business” under the California Consumer Privacy Act for the provision of such services.

 

Amendments to the PayPal Zettle Terms and Conditions

Effective: September 21, 2021

  • We are updating the PayPal Zettle Terms and Conditions so that they link to and incorporate the PayPal Data Protection Addendum for Card Processing Products for the applicable data protection terms.

 

Amendments to the PayPal Data Protection Addendum for Card Processing Products

Effective: September 21, 2021

  • We are updating the data protection provisions to reflect that PayPal is now a “Business” under the California Consumer Privacy Act for the provision of the services. 

 

Amendments to the PayPal Alternative Payment Methods Agreement

Effective: September 21, 2021

  • We are revising the Agreement to prohibit acceptance of payments for certain goods and services.

 

Amendments to the Commercial Entity Agreement

Effective: September 30, 2021

  • Wells Fargo Bank, N.A. (“Member”) is amending the “Commercial Entity Agreement with Wells Fargo” to make certain updates necessary to consolidate previous versions of such Agreements that applied based on the PayPal products and services used.

 

Amendments to the PayPal Pools Terms and Conditions

Effective: September 30, 2021, or as otherwise set forth below.

We will discontinue and retire the Pools Program and corresponding Pools services as of November 8, 2021, and:

  • the ability to create new Pools will be disabled on September 30, 2021;  
  • all existing open Pools will have a maximum duration of 30 days applied starting September 30, 2021, and will therefore expire on October 30, 2021 if not already terminated prior to that date;  
  • you will need to move any funds from your existing Pool(s) into your PayPal balance before November 8, 2021. Otherwise, we will move any remaining funds for you into your PayPal balance on or after that date;  
  • if you currently are (or have been) a Pool creator, please keep a copy of the list of contributors to your Pools for recordkeeping. Records of your Pool(s) will no longer be available after November 8, 2021.

Effective: March 11, 2021

  • We are revising the listed exclusions to PayPal’s Purchase Protection and Seller Protection to be globally consistent and to clarify which transactions are eligible for protection.
  • We are revising PayPal’s Seller Protection so it does not apply where a merchant ships a physical item or fulfills a purchase order more than two days after being notified by PayPal that the transaction is being disputed, reversed, or is otherwise unauthorized.
  • We are clarifying our PayPal Payouts and Mass Pay services terms, including that they may only be used to make multiple or bulk payments, not individual or other ineligible payments, and that merchants are responsible for obtaining the applicable consents from their payout recipients.
  • We are clarifying the terms that govern communications between you and PayPal.
  • We are clarifying PayPal’s data protection roles and responsibilities in connection with the processing of personal data using the PayPal services.
  • We are updating our Agreement to Arbitrate to modify the process and timeframe for submission of and responses to Notices of Dispute, and to clarify the application of American Arbitration Association rules.

  • We are clarifying the terms that govern communications between you and PayPal.
  • We are clarifying PayPal’s data protection roles and responsibilities in connection with the processing of personal data using the PayPal services.
  • We are updating our Agreement to Arbitrate to modify the process and timeframe for submission of and responses to Notices of Dispute, and to clarify the application of American Arbitration Association rules.

There is no action needed from you as the changes will occur automatically on the applicable effective dates. In the event you would prefer to decline the changes and close your account, you can do so prior to the applicable effective date and the changes will not apply to you.

Amendments to the PayPal Account User Agreement

  • We are updating the policies which you agree to comply with when you open and use a PayPal account.
  • We are clarifying the circumstances under which Commercial Entity Agreements apply to business and personal accounts.
  • We are establishing a dispute fee and its terms and conditions for sellers.
  • When you use your PayPal account for a transaction that involves a PayPal currency conversion, the currency conversion spread will be as provided on our Fees page under the heading Currency conversion (or such other amount as may disclosed to you during the transaction). Upon the effective date of this update, the currency conversion spread for goods and services or send-money transactions will be 4%.
  • We are clarifying that your ability to use any payment method linked to your PayPal account to buy something at a seller’s physical store using an electronic terminal or to buy something at a seller’s physical store using your own mobile device and a QR code may be subject to certain limitations.

Amendments to the Paypal Cash and Paypal Cash Plus Terms and Conditions

  • We are updating the policies which you agree to comply with when you open and use a PayPal Cash account or PayPal Cash Plus account.
  • When you use your PayPal account for a transaction that involves a PayPal currency conversion, the currency conversion spread will be as provided on our Fees page under the heading Currency conversion (or such other amount as may disclosed to you during the transaction). Upon the effective date of this update, the currency conversion spread for goods and services or send-money transactions will be 4%.

Amendments to the Paypal Here Agreement

  • We are clarifying the fees payable by sellers in relation to in-store transactions processed through PayPal Here QR codes. Other fees for using the PayPal services may apply.

Amendments to the PayPal Privacy Statement (Effective October 16, 2020)

  • We are adding biometric data to the types of personal data which may be collected to accommodate voice recognition capabilities for increased security. Your consent will be requested before this data is collected. 

Amendments to the Electronic Communication Delivery Policy (Effective November 16, 2020)

  • We are revising the notice provision to better align with the PayPal Account User Agreement (including the amount of advance notice required for changes to this policy).

Amendments to the Commercial Entity Agreement (Effective November 16, 2020)

  • Wells Fargo Bank, N.A. and Wells Fargo Merchant Services, L.L.C. (collectively, “Member”) are amending the “Commercial Entity Agreement with Wells Fargo” to remove Member’s indemnity obligation to make the Indemnification provision unilateral and to update Wells Fargo Bank, N.A.’s business address.

(collectively, “Member”) are amending the “Commercial Entity Agreement with Wells Fargo – Pro” to remove Member’s indemnity obligation to make the Indemnification provision unilateral and to update Wells Fargo Bank, N.A.’s business address.

AMENDMENTS TO CERTAIN U.S. PAYPAL AGREEMENTS - Issued on July 31, 2020

We are updating certain PayPal agreements (listed below) that apply to U.S. customers. The changes described below will go into effect on July 31, 2020, or as otherwise set forth herein. There is no action needed from you, as the changes will occur automatically on the applicable effective dates. In the event you would prefer to decline the changes and close your account, you can do so prior to the applicable effective dates and the changes will not apply to you.

Amendments to the PayPal Account User Agreement

  • We are expanding our Seller Protection Program to include certain intangible goods and providing the terms and conditions with respect to the coverage of such intangible goods.
  • We are clarifying that our Seller Protection Program does not cover Unauthorized Transactions initiated in an environment not hosted by PayPal.
  • For “Significantly Not as Described” claims under our Seller Protection Program, we are clarifying that the item may not be returned to sellers or sellers may be required to accept the returned item and pay for the return shipping costs.
  • We are providing the terms and conditions under which we will automatically enroll eligible charities with PayPal Giving Fund (which relationship will be governed by the Nonprofit User Agreement) with the option to opt-out at any time.
  • We are excluding items intended for resale, including single item transactions or transactions that include multiple items, from reimbursement eligibility under our Purchase Protection Program.
  • We are requiring that buyers attempt to resolve their issues directly with sellers prior to filing a claim with us in order to be eligible for reimbursement under our Purchase Protection Program.
  • We are requiring that you notify us of any pricing errors or discrepancies within ninety (90) days of having access to your account statement(s) or other account activity information, otherwise we shall have no obligation to make any corrections.
  • We are clarifying the fees payable by sellers in relation to transactions processed through QR codes, which will be payable on and from October 1, 2020 (or a later date as determined and offered by us). Prior to this date, transaction fees on QR code payments are temporarily waived to help businesses impacted by COVID-19. Other fees for using the PayPal services may apply.
  • We are adding payments made in respect of gold (in physical form or in exchange-traded form) to the list of ineligible items and transactions under our Seller Protection Policy.

Amendments to the PayPal Website Payments Pro and Virtual Terminal Agreement

  • We are updating our data processing terms to better align with recent requirements of U.S. data protection law.
  • We are incorporating the American Express Merchant Operating Guide into the additional terms governing American Express Card acceptance and providing a URL link to such Operating Guide.

  • We are updating our data processing terms to better align with recent requirements of U.S. data protection law.

Amendments to the PayPal Account User Agreement (Effective March 12, 2020)

  • We are clarifying how merchants must treat PayPal and Venmo marks and payment methods offered at points of sale.
  • We are requiring that merchants publish customer service information, including at least one email address or customer service URL, and a telephone number, which must be readily accessible for review by merchants’ customers.
  • We are clarifying how linked payment methods and preferred payment methods are used for automatic payments and updating the terms and effect of automatic payment cancelations.
  • We are clarifying merchants’ obligation to cooperate with PayPal’s reasonable requests for financial statements and other information in a timely fashion.

Amendments to the Payflow Gateway Services Agreement (Effective March 21, 2020)

  • We are revising the notice provisions to better align with the PayPal Account User Agreement (including the amount of advance notice required for changes to the agreement).
  • We are adding Account Updater functionality terms and conditions. This functionality will be provided to all Payflow Gateway Services merchants that also use the Recurring Billing Service once such functionality is implemented. Account Updater will allow merchants to update their customers’ eligible card data stored with PayPal to enable seamless processing using: (i) the Recurring Billing Service or (ii) other eligible transactions through the gateway in the future.
  • To reflect the requirements of the California Consumer Privacy Act (“CCPA”), we are adding additional terms that outline PayPal’s responsibilities as a Service Provider under the CCPA.

  • We are revising the notice provisions to better align with the PayPal Account User Agreement (including the amount of advance notice required for changes to the agreement).

  • To reflect the requirements of the California Consumer Privacy Act (“CCPA”), we are adding additional terms that outline PayPal’s responsibilities as a Service Provider under the CCPA.
  • We are adding terms to allow merchants to accept certain card payments, even if an internet connection is temporarily unavailable (offline payments).
  • We are adding dormancy terms to allow PayPal to unenroll merchants from PayPal Here who do not use PayPal Here for a period of two or more years.

Amendments to the PayPal Complete Payments with Custom Card Fields and Virtual Terminal Agreement (Effective March 21, 2020)

  • PayPal Complete Payments with Customer Card Fields will now be referred to as “advanced credit and debit card payments.” The new name of this agreement also reflects this change.
  • We are revising the notice provisions to better align with the PayPal Account User Agreement (including the amount of advance notice required for changes to the agreement).
  • To reflect the requirements of the California Consumer Privacy Act (“CCPA”), we are adding additional terms that outline PayPal’s responsibilities as a Service Provider under the CCPA.

Amendments to the PayPal Business Debit Mastercard® Cardholder Agreement (Effective April 6, 2020)

  • We are clarifying several provisions throughout the agreement to better align with the PayPal Account User Agreement and our current processes, policies, and procedures. Such clarifications include the following:
    • the PayPal Business Debit Card (“Debit Card”) may only be used for business purposes;
    • by agreeing to the PayPal Business Debit Mastercard Cardholder Agreement, you also agree to PayPal’s and the applicable issuer’s privacy policies;
    • the funds you can spend through the Debit Card are limited to the available funds in your PayPal account and the available funds in a linked bank account (which is currently the only backup funding source that can be linked to your Debit Card);
    • we’ve added further detail on the reasons and hold periods for pre-authorizations;
    • subject to our discretionary approval, you are no longer limited to a maximum of one additional Debit Card;
    • we may share and disclose information with the applicable issuer, and vice versa, including information about you, your Debit Card, your PayPal account, etc., for various reasons such as servicing your Debit Card or PayPal account, updating your Debit Card or account information, etc.
  • We are adding the ability to suspend or cancel your Debit Card and corresponding PayPal account for excessive reports of card loss or theft.
  • We are adding the ability to cancel your Debit Card if it has been disabled for 60 days or longer.
  • Under the arbitration provision, we included language regarding severability of claims and specified which issues and disputes may be determined by a court and which ones must be determined by an arbitrator.
  • We are removing certain requirements for customers to participate in the standard 1% cash back program, including the requirement to have a PayPal Premier Account.
  • We are notifying customers of additional potential cash back programs related to the Debit Card with varying terms and conditions that may be offered from time to time.
  • We are revising the notice provisions to better align with applicable law.

Amendments to the PayPal Privacy Statement (Effective March 12, 2020)

  • We have rewritten our Privacy Statement to help make it easier for you to understand how we collect, process, and share personal data.
  • We are offering data subject access and deletion rights to all our customers in the U.S.

AMENDMENTS TO CERTAIN U.S. PAYPAL AGREEMENTS - Issued on January 1, 2020

We are updating certain PayPal disclosures that apply to U.S. customers in California. These changes will go into effect on January 1, 2020.


Amendments to the PayPal Privacy Statement

  • In accordance with the California Consumer Privacy Act, we are updating our U.S. Privacy Statement to:
    • disclose the categories of personal information we collect, purposes for which personal information is used, and categories of third parties with whom it is shared; and
    • provide information about the rights you may have under the California Law.

We are updating certain PayPal agreements that apply to U.S. customers. These changes will go into effect on September 3, 2019. If you agree to these changes, you don’t have to do anything. If you don’t agree with these changes, you may close your account before September 3, 2019 and these changes will not apply to you.

 

Amendments to the PayPal Account User Agreement and the PayPal Cash and PayPal Cash Plus Terms & Conditions

  • We are changing the PayPal currency conversion spread to 3.75% for transactions that involve a PayPal currency conversion when you pay for goods or services or send money.
  • We are changing the PayPal currency conversion spread to 3.0% for all other transactions involving a PayPal currency conversion.

 

Amendments to the PayPal Website Payments Pro and Virtual Terminal Agreement

  • We are changing the PayPal currency conversion spread to 3.0% for all transactions involving a PayPal currency conversion.
  • We are providing the terms and conditions for our Account Updater functionality. When made available, Account Updater will allow merchants to update their U.S. customers’ eligible card data stored with PayPal to enable the seamless processing of recurring billing, recurring payments, and/or other eligible transactions.

AMENDMENTS TO THE PAYPAL ACCOUNT USER AGREEMENT AND THE PAYPAL WEBSITE PAYMENTS PRO AND VIRTUAL TERMINAL AGREEMENT - Issued on July 9, 2019

We are updating the PayPal agreements listed below for U.S. customers. The changes described below will go into effect on July 9, 2019. There is no action needed from you, as the changes will occur automatically on the effective date above. In the event you would prefer to decline the changes and close your account, you can do so prior to the effective date and the changes will not apply to you.

 

Amendment to the PayPal Account User Agreement for Buyers

  • If PayPal performs a currency conversion for your purchase, and the purchase is refunded at a later date, PayPal will perform a currency conversion for the refund at the transaction exchange rate in effect on the date of the refund.

 

Amendment to the PayPal Account User Agreement for Sellers

  • We’re updating our User Agreement in anticipation of expanding our capabilities for PayPal Payouts. PayPal Payouts is being enhanced to allow payments to be directed to Venmo account holders in addition to PayPal account holders.
  • PayPal may use any of the payment methods linked to a seller’s PayPal account to prevent the seller’s account from becoming negative when there are not sufficient funds in the account for seller refunds, reversals and chargebacks.

 

Amendments to the PayPal Website Payments Pro and Virtual Terminal Agreement

  • Merchants can now accept debit network branded cards.
  • We’ve clarified merchant’s obligations regarding certification of PCI DSS compliance.

AMENDMENTS TO THE PAYPAL ACCOUNT USER AGREEMENT - Issued on May 7, 2019

We are updating the PayPal Account User Agreement for U.S. customers. These changes will go into effect on May 7, 2019. If you agree to these changes, you don’t have to do anything. If you don’t agree with these changes, you may close your account. If you close your account before May 7, 2019, the changes will not apply to you.

 

Amendments to the PayPal Account User Agreement

  • We’re removing the flat rate pricing for sending money to friends and family members who have PayPal accounts in a country other than the United States and introducing a new variable fee of 5% based on the amount you send with a minimum of $0.99 and a maximum of $4.99 per transaction. We’re also removing any variation depending on the recipient’s country.
  • We are changing the currency conversion spread to 3.25% over a base exchange rate in situations where you are a sender of money in a PayPal transaction.
  • We’re changing how we treat refunds. If you refund (partially or fully) a transaction to a buyer or a donation to a donor, there are no fees to make the refund, but the fees you originally paid as the seller will not be returned to you.

AMENDMENTS TO THE PAYPAL USER AGREEMENT AND THE ELECTRONIC COMMUNICATIONS DELIVERY POLICY - Issued on March 29, 2019

We are updating the PayPal Account User Agreement and the Electronic Communications Delivery Policy. These changes will go into effect on March 29, 2019 and apply to U.S. PayPal customers. If you agree to these changes, you don’t have to do anything. If you don’t agree with these changes, you may close your account. If you close your account before March 29, 2019, the changes will not apply to you.

 

Amendments to the PayPal User Agreement for Personal PayPal Accounts

  • As a result of a new regulation issued by the Consumer Financial Protection Bureau in Washington, D.C. coming into effect on April 1, 2019, we are making some changes that will affect consumers who want to hold and use balance with PayPal.
    If you want to hold and use balance, you will need a balance account which will be linked to your current PayPal account. PayPal will offer two balance accounts: PayPal Cash and PayPal Cash Plus. Information about both types of balance accounts can be found in the PayPal Cash and PayPal Cash Plus Terms and Conditions.
    If you are an existing personal PayPal account holder and we have already verified your identity, we will establish and automatically link a PayPal Cash Plus account to your current PayPal account. Information about your PayPal Cash Plus account, including your balance amount, will be easily available using your existing PayPal login.
    For all other consumer PayPal account holders, if you want to hold and use balance, in addition to verifying your identity with PayPal, you will need set up a balance account which will be linked to your current PayPal account.
    There are no changes to any PayPal fees.
  • We are also making two other changes: (1) we are changing the time period for providing you with advance notice about important changes to the PayPal Account User Agreement to at least 21 days; and (2) we are clarifying how and when we convert currency.

  • We are changing the time period for providing you with notice about important changes to the PayPal Account User Agreements to at least 5 days.
  • We are clarifying how and when we convert currency.

 

Amendments to the Electronic Communications Delivery Policy

We are updating our Electronic Communications Delivery Policy to clarify that your consent to receive electronic disclosures under our Electronic Communications Delivery Policy applies to all PayPal branded accounts
